Happy Holidays from Demorest Law Firm!

Demorest Law Firm would like to take the opportunity to thank everyone for another great year.  This year we have had lots to celebrate.  Mark was selected as an Oakland County Civil Mediator and as a case evaluator for the business court division of Wayne County Circuit Court.  In addition, Mark was rated as a “Superb” attorney by AVVO and once again selected as a Super Lawyer by Super Lawyer Magazine.  Melissa also was honored again as a Rising Star by Super Lawyer Magazine, and was selected as a member of Michigan Lawyers Weekly’s distinguished class of Up and Coming Lawyers of 2014.  Mike and his wife, Kristin, recently adopted a baby boy. Lisa, the most recent addition to the firm, passed the Michigan bar exam.

We also had some great wins in court on behalf of our clients this year.   Three of our clients had inverse condemnation claims pending against the City of Detroit when it filed for bankruptcy.  The U.S. Bankruptcy Court for the Eastern District of Michigan agreed that our clients’ claims could not be reduced in bankruptcy, because these claims were protected by the U.S. Constitution.  Nearly every other claim filed by a creditor was reduced to pennies on the dollar.

We also successfully represented a client before the Michigan Court of Appeals, which ruled in favor of our client, an employee whose employment was terminated by the defendant back in 1992.  At the time his employment was terminated, he was given nothing for his stock because the company deemed it to be worthless.  However, because there were procedures in place to have a neutral party value the stock and the corporation failed to follow that procedure, the Court found that the employee still maintained the same ownership interest in the corporation now that he owned prior to his termination in 1992.
